Recently, the Southern Nevada Health District (SNHD) issued a directive requiring us to remove all consumable CBD and kratom products — despite these being 100% legal in the State of Nevada. They’re citing FDA guidance (see below) to override state law, and classifying us as a “food establishment” despite the fact that 90% of our inventory is prepackaged and labeled in compliance with federal packaging standards.

Food establishments are not approved to sell dietary supplements or conventional foods containing CBD and are not allowed to add CBD to any consumable product.
The Southern Nevada Health District (SNHD), following FDA’s guidance, considers CBD an unapproved dietary supplement and an unsafe food additive.
Therefore, any dietary supplement or conventional food containing CBD is considered adulterated and cannot lawfully be sold or offered to the public as a consumable product in Clark County.
- Kratom Directives:
Food establishments are not approved to sell dietary supplements or conventional foods containing kratom and are not allowed to add kratom to any consumable product.

Therefore, any dietary supplement or conventional food containing kratom is considered adulterated and cannot lawfully be sold or offered to the public as a consumable product in Clark County.
- Kava Directives:
Food establishments are not approved to add kava as an ingredient to food or sell food containing kava. The Southern Nevada Health District, following FDA’s guidance, considers kava an unapproved food additive.
Kava is not generally recognized as safe (GRAS) per 21 CFR Part 170.30. Additionally, per FDA, “ kava has been shown to interact with a number of other drugs, herbs, and dietary supplements and co-administration of these substances
with kava may lead to serious negative consequences”. Therefore, any conventional food containing kava is considered adulterated.
Meanwhile, dozens of other shops continue selling the same products unchecked. We were told by SNHD that they “haven’t gotten to them yet,” which means enforcement is inconsistent and harmful to small, compliant businesses like ours. This action puts 80% of our revenue at risk and threatens our ability to stay open.
