California Local City and County Laws

Many local jurisdictions have enacted their own ordinances regarding kratom, which vary from complete bans to age restrictions:

    •    Banned: The cities of San Diego, Oceanside, and Newport Beach have prohibited the sale, distribution, or possession of all kratom products within their city limits. Los Angeles County and Orange County have also issued directives requiring retailers to stop selling these products.

    •    Regulated: Fresno County and Riverside County have passed ordinances that allow the sale of kratom under specific conditions, such as age restrictions (must be 21 or older) and limits on alkaloid concentrations, particularly 7-OH.

    •    Unregulated: In areas without specific local ordinances, the legality of individual use remains in a complex gray area, but the sale for consumption still falls under the CDPH’s enforcement actions.

Advocates are actively working so that kratom remains legal.
