2018 is in session. We now have 7 states with active bills to regulate and ban  kratom. Most states are geared toward making the leaf of the kratom tree a schedule 1 substance like heroine and LSD. Most of the new States which have popped up  this week are in the south eastern part of country. The south historically have been more difficult to educate and seem more stubborn than other parts of the country. We need to educate these states and get the science and the facts in front of them. As a community we need Dr’s, rehabilitation experts, toxicologists and some top notch representation. Some of these are what is known as a companion bill which means it is essentially a copy one for the House and one for the Senate.

(a) Schedule I shall consist of the drugs and other substances, by whatever official name, common or usual name, chemical name, or brand name designated, listed in this section including their isomers, esters, ethers, salts and salts of isomers, esters and ethers, whenever the existence of these isomers, esters, ethers and salts is possible within the specific chemical designation. Mitragynine, 7-hydroxymitragynine (Kratom);





(1) Unless specifically excepted or unless listed in ano ther schedule, it is an offense to knowingly produce, manufacture, distribute, sell, offer for sale, or possess any capsule, pill, or other product composed of or containing any amount of Kratom, in its natural botanical form, or any capsule, pill, or othe r product composed of or containing any amount of mitragynine or hydroxymitragynine.






Be it enacted by the People of the State of Illinois,
represented in the General Assembly:
Section 5. The Kratom Control Act is amended by changing
Section 1 as follows:
(720 ILCS 642/1)
Sec. 1. Short title. This Act may be cited as the the
Kratom Control Act


Amends the Kratom Control Act. Provides that a person (rather than a minor under 18 years of age) shall not knowingly purchase or possess any product containing any quantity of Kratom. Provides that a person shall not knowingly sell, buy for, distribute samples of, or furnish any product containing any quantity of Kratom to any person (rather than a minor under 18 years of age). Provides that a violation is a Class B misdemeanor. Provides that the knowing sale, buying for, distributing samples of, or furnishing any product containing any quantity of Kratom is a Class B misdemeanor for which the offender shall be fined an amount of not less than $500.

Prohibits the sale or distribution of kratom.


Prohibits of the sale of kratom to individuals under the age of eighteen; defines “kratom” as any part of the plant Mitragyna speciosa, whether growing or not, and any compound, manufacture, salt, derivative, mixture, or preparation of such plant; imposes a civil penalty of not more than five hundred dollars for the sale or provision of kratom to any person under the age of eighteen.
